Banks City Council takes action to address dog issues

BANKS, Ark. – In response to a surge in complaints from residents regarding excessive dog barking and related health and safety issues, the Banks City Council has enacted a significant amendment to the existing dog ordinance. The decision, made on Tuesday evening by a 4 to 1 vote, imposes restrictions on the number of dogs allowed per household within the city limits of Banks.

The newly amended ordinance, designated as No. 1-2019, introduces a maximum limit of four dogs per household, with immediate effect. Notably, this amendment does not grandfather any existing dog owners, meaning all residents must comply with the updated regulations.

The amended ordinance has been officially filed in the district court office and the sheriff’s office.

It’s important to note that neither the Mayor nor members of the Banks City Government are authorized to file complaints on behalf of residents, businesses, or churches.

To initiate a complaint, individuals are required to contact the sheriff’s office at (226-3464 ext. 6) or dial 911 in case of emergencies. Upon the arrival of a presiding deputy, complainants must sign a citation.

The original ordinance, No. 1-2019, outlines various provisions aimed at ensuring public safety and mitigating disturbances caused by dogs. Specific points include the prohibition of vicious and problem dogs running astray, definition of vicious and problem dogs, regulations on barking and howling, conditions of premises, and restrictions on the number of dogs owned, kept, or harbored.

The ordinance emphasizes that it is unlawful for any person to keep a dog that, by loud and frequent barking and howling, disturbs the peace and quiet of neighboring residents. Additionally, individuals are obligated to maintain their premises free from offensive odors, systematically remove animal waste, and adhere to a limit of four dogs over 12 weeks old within the city limits.

Any violation of these provisions may result in fines ranging from $250.00 to $500.00 upon conviction.

The City Council declared an urgent and pressing need for this amendment, citing the preservation of public peace, health, safety, and welfare as the driving force behind this decision. The amended ordinance is now in full force, effective immediately.
